Terms of Use

These Terms of Use ("Terms") govern your use of the Freebird iPhone app and this website (together, the "Service"), provided by Freebird ("we," "us"). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Freebird is an independent aggregator that gathers publicly available offers — birthday rewards, free samples, brand sign-up bonuses, and national free days — into a calm, sectioned feed, with optional local reminders before birthday sign-up deadlines. The Service is free to use and supported by clearly labeled ads.

2. No account

The Service requires no account, sign-in, email, or password. Your birthday, interests, ZIP, saved items, and value ledger are stored only on your device, as described in our Privacy Policy. You are responsible for the device on which the Service runs.

3. Eligibility

You must be at least 13 years old (or the minimum age of digital consent where you live) to use the Service. By using it, you represent that you meet this requirement.

4. Offers, third parties, and brands

Freebird is an independent service and is not affiliated with, endorsed by, or sponsored by any brand listed, unless a card is explicitly marked as sponsored. Brand names and logos are the property of their respective owners and are used only to identify the offers we aggregate.

Offers are provided by third parties, not by us. They may change, be limited, require enrollment or purchase, or end at any time, and availability may vary by location. We strive to keep the feed current and show a "last verified" date on each offer, but we do not guarantee that any offer is available, accurate, or will be honored. Always review the brand's own terms before relying on or redeeming any offer. Your dealings with any third party are solely between you and that third party.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Reverse engineer, decompile, or attempt to extract source code, except where permitted by law;
  • Scrape, copy, or redistribute the feed or its contents for a competing service;
  • Interfere with, disrupt, or place undue load on the Service or its infrastructure;
  • Misuse offers, submit false reports, or attempt to defeat ad delivery in violation of these Terms.

6. Intellectual property

The Service, including its design, text, the Freebird name and feather mark, and original content, is owned by us and protected by intellectual-property laws. We grant you a personal, non-exclusive, non-transferable, revocable license to use the Service for your own non-commercial use, subject to these Terms. All rights not expressly granted are reserved. Third-party brand names and logos remain the property of their respective owners.

7. Advertising

The Service displays clearly labeled ads served by Google AdMob and any mediation networks it uses. There are no full-screen interstitials, and the moment you go to claim a reward is ad-free. Ads and advertising identifiers are handled as described in our Privacy Policy, including the App Tracking Transparency choice you control.

8. Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

9. Disclaimers

The Service is provided "as is" and "as available," without warranties of any kind, whether express, implied, or statutory, including any implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that any offer listed will be available, accurate, or honored. Some jurisdictions do not allow the exclusion of certain warranties, so some of the above may not apply to you.

10. Limitation of liability

To the maximum extent permitted by law, Freebird and its suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, data, or goodwill, arising out of or related to your use of (or inability to use) the Service, or out of any offer or third party, even if advised of the possibility of such damages. To the extent we are found liable, our total liability for any claim relating to the Service is limited to one hundred U.S. dollars (US$100), reflecting that the Service is provided free of charge. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

11. Indemnification

You agree to indemnify and hold harmless Freebird from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your misuse of the Service or your violation of these Terms or applicable law.

12. Changes to the Service and Terms

We may modify, suspend, or discontinue the Service, or any feed content, at any time. We may also update these Terms; we will revise the "Last updated" date above and, for material changes, provide reasonable notice in the app or on this page. Continued use after an update means you accept the revised Terms.

13. Termination

You may stop using the Service at any time by deleting the app, which also removes all on-device data. We may suspend or terminate access if you violate these Terms. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, and indemnification) will survive.

14. Apple App Store terms

If you obtained the app from the Apple App Store, these Terms are between you and Freebird, not Apple, and Apple is not responsible for the app or its content. Apple has no obligation to provide support or maintenance for the app. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you. You also agree to comply with the Apple Media Services Terms and Conditions and confirm you are not in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and are not on any U.S. Government restricted-parties list.

15. Governing law

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, except where mandatory consumer-protection law in your place of residence provides otherwise. If any provision is held unenforceable, the remaining provisions stay in effect.
